Terms of Use

This document contains information about payment, pricing, shipping, return, refund, and other matters related to the purchase and sale of items from the Apex Innovations Store. You agree that your purchase from the Apex Innovations Store is subject to the terms provided below.

Except as set forth in the Refunds + Returns policies, all purchases from Apex Innovations Store are final, non-cancelable and non-refundable.

You must at least 18 years old and have a valid credit card to order products and downloads from the Apex Innovations Store.

Payment + Pricing

Items in your Shopping Cart reflect the most recent price. Please note that this price may differ from the price shown for the item when you first placed it in your cart.

Payment Options

You can purchase items from Apex Store using any of the following card types: Visa, MasterCard, American Express, Discover. To purchase from the Apex Store in the United States, your credit card must have a U.S. billing address. The Apex Store does not accept checks, money orders, or other forms of payment.

Pricing

Pricing at the Apex Store is based on sales to individual consumers. If you are purchasing for a commercial, educational, or government organization, please contact us for more information.

Shipping and Tax

Shipping prices and tax depend on where the item is to be delivered. There is no shipping charge for software downloads or online courseware, of course, but there may be tax, depending on state and federal tax laws. The final price of a purchase, including shipping and tax, is calculated for the order before you actually make your purchase.

Orders + Shipping

Orders are processed after you click the 'Place the Order' button in the checkout process. Physical/non-downloadable items are shipped Monday through Friday during business hours. Online courseware is available almost immediately after purchase (details will be e-mailed to you immediately).

Shipping Options

The Apex Store cannot ship to P.O. boxes or personal mailboxes. FedEx requires a full street address. Rural route numbers are also okay, but may take some extra time for the package to reach its final destination.

Shipping fees are based on the shipment method. You have the option to select the shipping method at the time of purchase. We can ship via any option that FedEx supports to your address.

Tracking Your Order

You may use the website to track your order by logging in here: Your Account. Additionally, we will send you an e-mail with the tracking information as soon as we ship the product(s).

Returns + Refunds

We want you to be satisfied with the items that your purchase from the Apex Store. If you are not satisfied, you can return physical products within 30 calendar days provided they are in good condition. The Apex Store does not offer merchandise exchanges, however you can return a purchased item, receive a credit, and purchase a new item.

To Cancel an Order

• For physical items, you may be able to cancel an order before the items have shipped. To call us see the Contact Us page. After an order has shipped, you can return an item if you decide that you do not want it, subject to the certain limitations.

Before Returning a Purchased Item

• Call 1-866-294-4599 ext. 112 to get with help with downloading certain items or accessing purchased online courseware.
• Call us at 1-866-294-4599 ext. 112 to receive a Return Merchandise Authorization (RMA) number on any physical items you wish to return.

Items Qualified for Return

• Online courseware products that were purchased from the Apex Store within the last 30 calendar days and in which you have not logged in more that 30 minutes and/or taken any of the tests. For the return of any online courseware products, there is a 15% Return License ("Restocking") Fee.
• Shipped products in their original, unopened packaging, which were purchased from the Apex Store within the last 30 calendar days.

Downloadable items that have already been downloaded by you are not eligible for return.

We will replace, at no additional cost, any items received in damaged condition as a result of shipping or handling. Replacements will be sent once the damaged items are received in our offices.

Online Courseware

If you purchase online courseware from the Apex Innovations Store, your use of that courseware is under the terms of the license that is presented to you for acceptance for that software and not any other terms on the Apex Innovations Store site. Please see the Apex Innovations Coursware Terms & Conditions for more information.

You will not disassemble, decompile, or reverse engineer any courseware purchased from Apex Innovations Store.

Product Availability

We will make every effort to ensure that products appearing in and/or purchased by you from Apex Innovations Store are available, but we cannot guarantee that all items will be in stock or immediately available when you submit your order. We will not charge you for any unavailable items and will refund for any payments mistakenly made.

Delivery + Risk of Loss

Any delivery times quoted are estimates only. We will do our best to meet the delivery estimates, but we cannot guarantee particular dates. We will deliver to the address you have provided. You may not change the delivery address once an item has been shipped.

You shall not be entitled to reject items shipped to you, unless such items have been damaged in transit or the items are defective as they were shipped to you, and you notify us within 30 days of receipt. You retain all risk for damages to purchased products caused by your actions or negligence.

If you refuse delivery of any products that are conforming under these terms, you remain liable for payment and risk of loss passes to you. If you refuse to claim them after 30 days, we may dispose of them and set off the proceeds of sale against any sums you owe.

In the event of any under delivery, we may issue make goods or refunds, at our option. Unless separately provided by law, you will not be entitled to reject the products in whole or in part in the event items are under delivered, and you must pay for any products actually delivered to you.

Termination

If you become subject to voluntary or involuntary bankruptcy actions, you become insolvent, or you cease to do business in the ordinary course, we may refuse to ship or stop shipment of any items ordered by you.

Liability Limitation

IN NO EVENT WILL OUR LIABILITY EXCEED THE AMOUNTS PAID BY YOU FOR THE PRODUCTS GIVING RISE TO THE CLAIM, REGARDLESS OF THE CAUSE OF ACTION (WHETHER BASED IN BREACH OF CONTRACT, TORT, OR OTHER LEGAL THEORY). IN NO EVENT SHALL WE BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, CONSEQUENTIAL, PUNITIVE, LOST PROFITS, LOST REVENUE OR OTHER SIMILAR DAMAGES. THESE LIMITATIONS REMAIN IN EFFECT REGARDLESS OF WHETHER WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR WHETHER OR NOT THE REMEDIES FAIL OF THEIR ESSENTIAL PURPOSE.

Warranties

We make no separate warranties with respect to the products sold on this site. All warranties are provided with the products. WE MAKE NO SEPARATE EXPRESS OR IMPLIED WARRANTIES OR REPRESENTATIONS, AND DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSES, AND NON-INFRINGEMENT.

Export

All products on Apex Innovations Store are subject to United States export laws and regulations. You must comply with all domestic and international export laws and regulations that apply to the products. These laws include restrictions on destinations, end users and end use.

Personal Information + Privacy

Any personal information you provide to us in connection with your purchase of products is subject to the Privacy Policy

General Terms

We will not be liable to you for any loss, damage, or breach of any obligation by us due to an event outside our reasonable control, including, but not limited to war, riot, natural disaster, strike, civil disturbance, supply chain interruption, impossible use of private or public telecommunications network or other event of force majeure. For these or other reasons, we may elect to cancel your order.

These Apex Innovations Store Terms of Use, and the information incorporated by reference in these Apex Innovations Store Terms of Use constitutes the entire agreement of the parties with respect to your purchase of Products from Apex Innovations Store and supersedes all prior contracts or agreements between us. We may modify these terms (1) for this transaction, by providing notice to you for future effect and (2) for future purchases by posting them on our web site.

No waiver of these terms may be made unless such are in writing and signed by Apex Innovations.

These Apex Innovations Terms of Sale are governed by the laws of the State of Louisiana. Any disputes must be resolved in the federal or state courts in Lafayette Parish, Louisiana.
